Judge Rejects U.S. Navy Attempt to Dismiss Camp Lejeune Cancer Case

The Department of the Navy has made two requests for dismissal in Laura Jones’ lawsuit regarding her non-Hodgkin’s lymphoma and water contamination at North Carolina’s Camp Lejeune. Judge Terrence Boyle rejected the motion for dismissal for the second time last week. Jones was married to a Marine when she lived at Camp Lejeune from 1980 to 1983. During this time, the military knew that the water supply at the USMC base was contaminated with benzene, vinyl chloride, tetrachloroethylene (PCE), trichloroethylene (TCE), and other toxins, but they failed to remedy the situation in a timely manner, exposing over 1 million people to the contaminants. The motion to dismiss was based on the grounds of a 10-year statute of limitations, but Judge Boyle rejected it because Jones had not been diagnosed with her cancer within that period.
