An Occupational Painter and Mechanic Contracts AML

He spent his working life as an industrial painter and mechanic. For twenty years the paints and solvents he used daily contained the cancer causing chemical called benzene. The paint and solvent containers didn’t say the products contained benzene, so he didn’t know that every day he worked with paint and solvents he breathed in excessive levels of benzene. In his 50s, this painter and mechanic began feeling unwell and visited a doctor. The doctor diagnosed him with the cancer acute myeloid leukemia (AML). The disease progressed in a way that doctors recommended a stem cell transplant, which cost more than $1,000,000.

The painter/mechanic contacted our law firm and decided to file a lawsuit against the paint and solvent manufacturers for their negligence in producing paints and solvents without adequately informing users of the dangers posed by the product ingredients. At trial, our legal team presented the case to a jury, who agreed that the defendant’s benzene containing products caused his AML and found in his favor on both liability and damages.
