As a Texas automobile owner, you probably think you are alone if you end up with a vehicle with a significant defect. However, you may be aware of the Texas lemon law, which protects you and provides options for restitution if you purchased the vehicle in Texas and it has an original warranty from the manufacturer.

It also must be within a specific time frame since the purchase – namely the first 24,000 miles driven or the first 24 months you have owned it. There is an additional six-month window to notify the manufacturer of the ongoing defect beyond that timeframe. However, it is still a limited amount of time to discover, attempt to repair the defect, and notify the manufacturer to get assistance with the repair.

If you have purchased a vehicle in Texas and it has turned out to be a lemon, you may be entitled to relief under the Texas lemon law. This law is designed to protect consumers who have purchased a defective motor vehicle. To file a complaint under the Texas lemon law, you must first complete and submit a written complaint to the motor vehicle manufacturer or its authorized representative.

When submitting your complaint, you must provide the following information:

  1. the name and address of the motor vehicle manufacturer
  2. the name, address, and telephone number of the authorized representative of the manufacturer
  3. the date of purchase of the motor vehicle
  4. the serial number, make, model, and year of the motor vehicle
  5. a description of the condition or defect in the motor vehicle.
  6. In addition, you should include any copies of repair orders, invoices, and other documents that may be relevant to the complaint.

Once you have submitted your complaint, the motor vehicle manufacturer or its authorized representative will be required to investigate the complaint and respond to you with a written notice.

This notice must contain an explanation of the manufacturer’s or authorized representative’s findings, the proposed resolution, and an explanation of the manufacturer’s or authorized representative’s decision.

If the manufacturer or authorized representative decides that the motor vehicle is a lemon, they must provide you with a full refund or replacement vehicle. The manufacturer must also reimburse you for any repair costs associated with the lemon vehicle, as well as any other incidental costs such as towing expenses or rental car fees.

Filing a complaint against a major manufacturer can be stressful. You also need to make sure you have accurate and in-depth records of the various repair attempts you have made and the unsuccessful results. You need to gather other information and be prepared for the manufacturer to brush you off OR to offer a very lowball offer to get you to go away.

All of this can be challenging to navigate on your own. If you have a fulltime job, a family, a busy social or political life, or a million other things going on in your life and aren’t sure you can handle it all on your own – don’t worry.  You don’t have to.
