Nissan Lemon Law – Brake Fluid Fires

Nissan North America announced Sept. 18, 2018 they will recall more than 200,000 vehicles suffering an elevated fire risk.

The Franklin, Tennessee-based manufacturer notified the National Highway Traffic Safety Administration (NHTSA) that they will recall 215,124 2016-2017 Nissan Maxima, 2015-2017 Nissan Murano, 2017-2018 Nissan Pathfinder and 2017 Infiniti QX60 built from Aug. 22, 2015 to Feb. 24, 2017.

The affected vehicles contain anti-lock brake system (ABS) actuators built by Lebanon, Ohio-based manufacturer ADVICS North America, Inc. These actuators contain an oil seal manufactured outside specification: specifically, a die temperature variation may have compromised the seal’s hardness. This, combined with insufficient lubrication, can make the seal wear prematurely. This condition can let brake fluid leak and create an electrical short in the actuator circuit, increasing fire risk.

Nissan first received reports of previously recalled vehicles triggering ABS warning lamps in January 2018. Those vehicles were recalled on Aug. 31, 2016 for the same oil seal problem. Nissan began a joint investigation with ADVICS in February 2018, began monitoring field data and examining returned parts. Durability testing conducted between July and August 2018 found seal hardness and insufficient lubrication around the seal affected the seal’s durability.

The company decided on a safety recall on Aug. 30, 2018.

Nissan will notify owners and dealers will inspect the serial number on the ABS actuator and replace it as necessary, free of charge. The recall will begin Oct. 15, 2018. Owners may contact Nissan customer service at 1-800-867-7669. Note: When brake fluid has leaked onto the circuit board, the ABS warning lamp will remain illuminated for more than 10 seconds after engine start up. If this occurs, owners are advised to park the vehicle outdoors away from other vehicles or structures and to not drive the vehicle.

Your vehicle’s manufacturer is legally required to fix any recalled problems for free. If the dealership refuses to fix the part or tries to charge you for the repair, contact the manufacturer immediately. The Highway Safety Act of 1970, which created the NHTSA, requires car manufacturers to pay for the recall and replacement of a defective part.
