Most people relate lemon laws to consumer vehicles, but that’s not always the case. In Texas, motor homes, and towable recreational vehicles (TRVs) are covered under Texas lemon law. To meet coverage under the lemon law, it’s important that your motor home or TRV meets certain conditions and have a substantial manufacturing defect or generates a serious safety hazard. Remember, that defect must be covered by a manufacturer’s written warranty. The owner should report any defect to the dealer or manufacturer within the warranty term by providing the manufacturer with written notice of the defect and at least one opportunity to fix the defect. For your protection, it’s always a good idea to send the notice via certified mail. This will add proof that you did send a notice. As the owner, you have the right to give the dealer or manufacturer a fair number of attempts to make necessary repairs.

Texas is one of just over half a dozen states that covers these vehicles under its lemon law, it can get a bit tricky. Therefore it’s essential to contact a Lemon Law Attorney to ensure all your rights are protected. Know what you are signing when purchasing to avoid any issues if you discover that you have purchased a lemon, because you may have to fight in in court. If you don’t understand what you’re signing, ask questions first. Be cautious of any terms with which you are unfamiliar, and scrutinize the contract and warranty before making the purchase. Manufacturers must make warranties on their products easy to read and readily available by law.

As with vehicles, lemon law complaints for motor homes and TRVs must be filed within six months following the earliest of the expiration of the express warranty term, 24 months after purchase or 24,000 miles succeeding the date of motor home – TRVs are excluded. It important to note that the filing period is established according to which even occurs first. It is highly recommended that you file as soon as you discover that the deal/manufacturer is having difficulties concerning repairs.

Do not expect to get upgrades at no additional costs. Once you and your Lemon Law Attorney prove your case, it will be based on the core guidelines of the Texas Lemon Law; however, each case may be decided upon on a case by case basis. The manufacturer is required to conform to the statutory provisions under Chapter 2301, Subchapter M of the Texas Occupations Code. The manufacturer must replace the defective motor home or TRV with one that is comparable to the original. Your Texas Lemon Lawyer may also be able to have your out-of-pocket expenses reimbursed if you paid for repairs that should have been covered by the warranty.

During the coronavirus pandemic, many Texans have opted to be a little more creative with their travels and buy TRV’s to avoid crowds, planes and hotels. It’s a convenient and economical way to travel. But don’t get fooled with the attraction of a great deal that will cause you to end up with a lemon. Airstream, the luxury of TRV’s is attracting many of the new remote workers. The pandemic has driven the RV industry to record levels. According to the RV Industry Association, U.S. RV makers shipped more than 400,000 vehicles in 2020, a 6% increase over 2019. The organization expects another 20% increase in shipments this year, which would be close to an all-time peak.
