Steve Baughman Jensen’s appellate court victories include two landmark cases decided by the United States Supreme Court on behalf of asbestos victims. In those two cases, Steve successfully fought two proposed nationwide class action settlements that attempted to cutoff the rights of“future” asbestos victims who had been exposed, but had not yet developed any disease. The United States Supreme Court overturned both settlements in the cases of Amchem v. Windsor, 521 U.S. 591 (1997) and Ortiz v. Fibreboard Corp., 527 U.S. 815 (1999).
Mesothelioma
Mesothelioma is a cancer typically found in the lining of the lung, which is caused by exposure to asbestos fibers or dust and strikes persons who worked with asbestos products. This type of lung cancer usually develops many years after the patient was exposed to asbestos.
Manufacturers of products that contained asbestos and the owners of premises where asbestos products were used generally knew about the hazards of asbestos, but they failed to protect workers.
